MEMBERSHIP AGREEMENT

Please read the following Agreement carefully before registering on our website.

1. Parties
   a) Lucavien, located in İstanbul, Turkey, operator of the website www.lucavien.com (hereinafter referred to as “Seller”).
   b) The Internet user who registers on www.lucavien.com (hereinafter referred to as “Member”).

2. Subject Matter
   The purpose of this Agreement is to define the terms and conditions under which the Member may benefit from the website www.lucavien.com owned by the Seller.

3. Rights and Obligations of the Parties
   3.1. The Member represents and warrants that all personal and other information provided when registering on www.lucavien.com is accurate and complete under the law, and undertakes to indemnify and hold harmless the Seller for any damages arising from any inaccuracy thereof without delay.
   3.2. The Member’s password provided by the Seller is strictly personal and may not be disclosed to any third party or organization. Any and all liabilities arising from unauthorized use of that password, as well as any claims or demands from third parties or authorities against the Seller, shall be the Member’s sole responsibility, and the Seller reserves all rights to seek compensation for any losses or other remedies resulting from such unauthorized use.
   3.3. The Member undertakes to comply with all applicable laws while using www.lucavien.com and agrees not to violate them. Otherwise, all legal and criminal liabilities shall rest solely with the Member.
   3.4. The Member shall not use www.lucavien.com for any purpose that disrupts public order, offends public morality, harasses or disturbs others, violates intellectual property rights, or is otherwise unlawful. Nor shall the Member engage in any activities or operations that prevent or hinder others from using the service (e.g., spam, viruses, Trojan horses).
   3.5. All opinions, ideas, and content expressed by Members on www.lucavien.com are the sole responsibility of the Members and do not reflect the views or endorsement of the Seller. The Seller shall have no liability for any damages suffered by third parties arising from Members’ statements, nor for any damages suffered by Members due to statements made by third parties.
   3.6. The Seller shall not be liable for unauthorized access to or damage of Member data. The Member accepts in advance that they shall not claim any compensation from the Seller for any loss or damage arising from use of www.lucavien.com.
   3.7. The Member agrees not to access or use the software or data of other Internet users without permission. Any legal or criminal liability arising therefrom shall be borne solely by the Member.
   3.8. Any Member who breaches one or more provisions of this Membership Agreement shall be personally liable for any resulting legal or criminal consequences and shall hold the Seller harmless. In addition, should the matter be brought before judicial authorities, the Seller reserves the right to claim compensation from the Member for breach of the Agreement.
   3.9. The Seller reserves the unilateral right at any time to delete a Member’s registration and to remove any files, documents, or information belonging to the Member. The Member accepts this in advance, and the Seller shall bear no liability in such cases.
   3.10. All software and design of www.lucavien.com are the exclusive property of the Seller and are protected by copyright and other intellectual property laws. The Member may not use, acquire, or modify them without permission. Any other companies or products mentioned on this website are the trade marks of their respective owners and are likewise protected by intellectual property rights.
   3.11. The Seller may collect certain technical information—such as the Internet Service Provider’s name and IP address used to access the site, access date and time, pages visited, and referring website—from Members for the purpose of improving and developing www.lucavien.com or as required by law.
   3.12. The Seller may disclose Member personal data (a) when legally required, or (b) when the Seller, acting in good faith, deems disclosure necessary to comply with legal requirements or to protect the rights and property of the Seller and its affiliates.
   3.13. The Seller takes reasonable measures to ensure that the website is free of viruses and similar malicious software. However, the Member is responsible for procuring and maintaining their own antivirus protection. By accessing www.lucavien.com, the Member accepts responsibility for any errors in their own software or operating system and any consequences thereof.
   3.14. The Seller reserves the right to modify the website’s content, to change or discontinue any service offered, or to delete Member data at any time.
   3.15. The Seller may amend, update, or cancel the terms of this Membership Agreement at any time, without prior notice. Any changed, updated, or repealed provision shall become effective for all Members as of the date of publication on the website.
   3.16. The Parties agree that the Seller’s computer records shall constitute the sole and conclusive evidence in accordance with Article 287 of the Turkish Code of Civil Procedure (“HUMK”) and that such records shall be deemed an evidentiary agreement between the Parties.
   3.17. The Seller is authorized to send informational emails to Members’ registered email addresses and SMS to their registered mobile numbers. By accepting this Membership Agreement, the Member consents to the receipt of such communications.

4. Termination
   This Agreement shall remain in force until the Member cancels their membership or the Seller terminates it. The Seller may unilaterally terminate a Member’s membership and this Agreement if the Member violates any provision hereof.

5. Governing Law and Jurisdiction
   Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the Courts and Enforcement Offices of İstanbul, Turkey.

6. Effectiveness
   By registering as a Member, the Member acknowledges that they have read and accepted all provisions of this Membership Agreement. This Agreement is concluded and enters into effect upon the Member’s registration.
